But despite being a necessary law, this procedure is not as simple as one might imagine.

As we have already mentioned, this procedure is not necessarily an immediate process. Quite the opposite.

First, we have the appointment of the person responsible for the registration.
If the professional who is carrying out the registration comes to the conclusion that the name in question could cause any type of embarrassment, the registry clerk may question the parents regarding the choice of name.
At this stage, the professional is guided to present names as alternatives for the parents to choose.
If it is still not possible to reach a conclusion, the person responsible may refuse registration.
Of course, parents may disagree with this decision and appeal the refusal of the name. From that moment on, the decision is submitted to a judge.
And it is important to emphasize that this type of resource in relation to names that cannot be registered is not only linked to the issue of possible constraints that the name may generate.
The spelling of the name in question may also be a criterion used by the clerk to refuse to continue with the registration process.
For example: in names where parents want to register the child with names with an excess of letters. In this case, the registrar can also contest the name.
And in cases where the name on the register is of foreign origin, the registrar may also request that the parents present proof of the existence of this name in other languages/countries.
If this question arises, it is only after verification that it is possible to continue with the registration process.
